Seller Contract, To Sell At Auction

  1. The auction company will determine whether to sell items online or live only. Items are NOT guaranteed to be listed online.

  2. All animals must be caged the way they are to be sold.

  3. All sick animals will be asked to leave.

  4. Bricker Auction Company is not liable for the well-being of any animals before, during, or after the auction and cages.

  5. No selling animals before the auction.

  6. Seller is the exclusive owner of goods and has the right to sell them. Auctioneers will be held harmless.

  7. NO RESERVES and NO GUARANTEES.

  8. All cages MUST have water/food bowls and bedding.

  9. Market conditions are based on the economy.

Rates

Cost covers auctioneer, clerk, cashiers, ring crew, auction labor set up and clean up, advertising, building rental, and administration & software costs for online and in-person auctions.

Base Rate

$1 + 22% commission rate per lot sold

Terms & Conditions

  1. Do not bring animals in cardboard boxes.

  2. Please have your animals caged the way you want them to sell. We will sell the number of animals in the cage times the price.

    Ex: If four animals are in one cage and it sells for $4.00, it will be clerked 4 x $4.00 = $16.00

  3. All cages MUST have water/food bowls and bedding.

  4. All items consigned are sold without reserve, to the highest bidder. There are no guaranteed prices.

  5. Puppies 8-16 weeks old must have up-to-date vaccines and vet checks with documentation proof for each puppy to be sold. NO ADULT DOGS.

  6. Lost checks are subject to charges. Stop payment fees are $32.00.

  7. The auctioneer will deduct the commission from the proceeds.

  8. In the event of non-payment by the buyer, the auctioneer, in its sole discretion may (a) offer the property at a future auction, (b) cancel the sale and return the property to the owner. The auctioneer shall not, under any circumstances, be liable for any consequential damages to the owner as a result of non-payment by the buyer.

  9. Bricker Auction Company has the right to charge a buyer's premium, and that belongs to the auction company.

  10. Auctioneers do not warrant the safety or working conditions of anything sold.

  11. No animals can be removed after consigned unless approved by auction staff.

  12. Any check lost in the mail will need two full weeks from the date mailed to be returned to Bricker Auction Company by the post office. After such time, a check will be reissued.

  13. Checks are not guaranteed on the day of the auction and will be mailed out 7 to 15 days after the completion of the auction.

  14. The signature of the consignment contract is a legal and binding contract and agreement of our terms.

  15. In the event of an absentee bid, the auctioneer acts as a dual agent representing both buyer and seller fairly.

  16. 20% buyback fee
