All items consigned are sold without reserve, to the highest bidder. There are no guaranteed prices on any item.
Indiana Laws state that you may NOT bid on your own merchandise. If you do bid on your own items, we will stop the auction and remove your consignment. The auctioneer will negotiate the termination of the auction.
The auctioneer reserves the right to sell all goods according to the marketability of the goods and refuse non-sellable goods.
Goods removed for any reason from the auction must be signed and accounted for.
Lost checks are subject to charges. Stop payment fees are $32.00.
The auctioneer will deduct the commission from the proceeds.
In the event of non-payment by the buyer, the auctioneer, in its sole discretion may (a) offer the property at a future auction, (b) cancel the sale and return the property to the owner. The auctioneer shall not, under any circumstances, be liable for any consequential damages to the owner as a result of non-payment by the buyer.
If the seller packs goods, auctioneers are not liable for damages.
Bricker Auction Company has the right to charge a buyer's premium, and that belongs to the auction company.
Appraisals are not a guarantee of auction prices.
We as auctioneers cannot establish a value for sentimental reasons, we can only sell at auction.
Auctioneers do not warrant the safety or working conditions of anything sold.
Any item removed by the seller, prior to auction, is subject to our fair market appraisal and double the commission.
Trash will not be hauled or thrown away for free. NO hazardous material, NO illegal items.
Any vehicle the auction company moves must have insurance and must provide all documents.
Any check lost in the mail will need two full weeks from the date mailed to be returned to Bricker Auction Company by the post office. After such time, a check will be reissued.
The signature of the consignment contract is a legal and binding contract and agreement of our terms.
Indiana Law states payment within 30 days.
We are an auction business and not a moving company by trade. For any moving of goods other than to be sold at auction, Bricker Auction Company will not be liable for any damages to property. We extend no insurance coverage on items in our possession. Your homeowners may cover your items.
In the event of an absentee bid, the auctioneer acts as a dual agent representing both buyer and seller fairly.
